Kvagnath said she had received a letter from the property owner and recommended forwarding that letter to counsel for review.
Kvagnath told the commission the town's land-use attorney had checked the court docket and there was no decision as of the meeting; she expected a ruling "probably within the next 30 days." A commissioner summarized the possible outcomes: the judge could rule the activity "as of right" or require that a permit was needed. The commission voted to refer the matter to attorney Andres for review and opinion rather than debating the matter during the public meeting.
