Fayston Planning Commission approves tighter Certificates of Occupancy language

The Fayston Planning Commission on Jan. 13 unanimously approved amendments to Section 9.4 of the town’s Land Use Regulations governing Certificates of Occupancy and Compliance. The revision codifies application timing, requires professional certification for new wastewater systems, and references state residential and commercial building energy standards (30 V.S.A. §§ 51 and 53).
Under the new language the Administrative Officer must issue or deny a certificate within 14 working days of a completed application; failure to act within that period causes the certificate to be deemed issued on the 15th day. The amendment also requires either recorded RBES/CBES documentation for energy standards compliance or, in owner-builder cases where construction deviates from RBES, a Vermont Owner/Builder Disclosure Statement on file. The regulations continue to require state-licensed engineer/site technician certification for wastewater installations and testing.
Commissioner Langford Davidson moved to adopt the edits to Section 9.4, Michael Duell seconded, and the motion passed with all members voting to approve. The Planning Commission recorded no additional conditions or amendments when it approved the updated text.
