Fayston planners move to align occupancy rules with Vermont RBES/CBES requirements

The Fayston Planning Commission on Nov. 18, 2024 discussed amending Section 9.4 of the town’s Land Use Regulations to require a Residential Energy and Building Standard (RBES) or Commercial Building Energy Standard (CBES) certificate when applicable for issuance of a Certificate of Occupancy. Commissioners noted the change would align the LURs with state law citations referenced at the meeting: 24 VSA 4449 and 30 VSA 51.
Commissioners agreed that Section 9.4(A)(2) needs clearer wording so the LURs and state statute match without removing existing requirements. Commissioner Langford Davidson and Zoning Administrator Jason Wilson were assigned to draft the revised text for review and a scheduled vote at the next Planning Commission meeting. No motion or formal vote on the amendment was taken on Nov. 18.
