La Cygne council approves Conditional Use Permit for U.S. Minerals, with strict conditions

The La Cygne City Council voted to approve Ordinance No. 1395, granting a Conditional Use Permit to U.S. Minerals to process residual fly ash from the nearby power plant in the La Cygne Industrial Park. Council deliberations spanned several meetings after an economic-development briefing by Dennis Arnold that the company would bring rail access and approximately a dozen jobs; Arnold told the council that “only a small amount of processing will occur at La Cygne.”
Council members and company representatives negotiated a set of operating conditions before the vote. The council amended two conditions to limit impacts: operations between 11:00 p.m. and 5:00 a.m. must not exceed 85 dB measured at the industrial-park north boundary, and the facility must remain in compliance with the Linn County sale agreement, with the City to be notified of any amendments. The permit requires dust-control plans, limits on outside storage height and prompt remediation steps if recurring nuisance or environmental issues arise. Mayor Keith Smith said the permit balances economic opportunity with community protections.
The Planning Commission had recommended approval after a public hearing; the council’s final vote reflected additional language requested by residents and the city attorney. The motion to approve Ordinance No. 1395 carried 5-0 (Council recorded vote: passed), and the council recorded the amended conditions in the ordinance.
