The Butler County Board of Commissioners unanimously approved PL 26-09 on April 28, 2026, authorizing a mortgage lot split at 21317 SW Purity Springs Rd near Douglass and placing roughly 70 acres into an Agricultural Preservation Overlay. Community Development Director Toby Stewart told the Board the owner, Lawrence Lay, seeks to deed approximately 10 acres to a son who plans to build a home; the newly created lot would rely on a private wastewater system and has rural water available nearby.
Stewart said the property is zoned AG-80, is outside the County Urban Growth Area and is surrounded by agricultural parcels. The Planning Commission recommended approval by a 5-0 vote. Commissioner Kelly Herzet moved to approve the Homestead Lot Split and Agricultural Preservation Overlay; Commissioner Jeff Masterson seconded and the motion carried 5-0.
