Court remand sends conditional-use case for event venue back to Butler County Planning Commission

Community Development Director Toby Stewart and County Counselor Terrence Huelskamp reviewed Journal Entry 2025-CV-259, a court order returning a conditional-use denial for further findings. The property in question is at 6333 SW Santa Fe Lake Rd., Augusta, Kansas; the court directed that three commissioners who voted to deny the application provide findings.
After discussion the Board voted to remand the matter to the Planning Commission to review records and to clarify the reasons for denial. Commissioner Darren Jackson moved for remand; Commissioner Kelly Herzet seconded and the motion carried 5-0. The item will be placed on the Planning Commission agenda next month for record review and additional findings before returning to the County Commission.
