City updates code to align with state law on mobile food vendors; P&Z approves locational controls

Andreina Davila of Development Services summarized code amendments to implement House Bill 2844, which delegates permitting for mobile food establishments to the state health authority while allowing cities to retain fire, location and zoning authority. "This house bill essentially removes the city's authority to be able to license and permit any mobile food establishment ... the state is the permitting agency for all food trucks," Davila said, and proposed code changes concentrate locational rules in Chapter 6 and update the fee schedule to reference the health district where appropriate.
Staff proposed locational restrictions (no operation on commercial collector or higher classification roadways, no encroachment into setbacks or fire lanes) and required display of state license and approved fire inspection. Staff noted about 20 active permitted food trucks in Cedar Park. Commissioners asked clarifying questions about definitions and setbacks; the commission approved the amendments by roll call.
