Board attorney warns of potential litigation over timing of referendum fund disbursements

Attorney Meeker updated the board on an ongoing dispute concerning the timing of disbursements of referendum funds to certain outside parties. Meeker said the board previously asked for an opinion from the Attorney General's Office and that, to date, the board has not received that opinion.
Meeker reported receiving correspondence from attorney Sean Arnold indicating he is prepared to pursue litigation if the parties cannot reach an amicable resolution on whether the district must release a portion of referendum funds prior to receipt. "We have yet to hear back from the Attorney General's Office," Meeker said, and he said he would pass Mr. Arnold's message on to the board. No board action was taken at the meeting on this item.
The exchange in the meeting established that the matter remains unresolved; Meeker will continue to communicate with counsel and update the board as more information becomes available or if litigation is filed.
