City staff presented code amendments to align Cedar Park ordinances with Texas House Bill 2844, which establishes state permitting and inspection for mobile food establishments and limits local governments’ ability to adopt conflicting duration or permitting requirements.
Adriana (Development Services) explained the amendments would remove city permitting and duration limits for mobile food vendors where state licensing applies, while keeping zoning, fire‑code, location, parking and buffer requirements in place. "We are removing any conflicting regulations from our current code and then shifting the regulations that we can still regulate to their appropriate locations in the city code," staff said. The amendments also consolidate definitions and move fee references to the county/health district fee schedule where appropriate.
Council members asked whether permitting fees were removed because the state now regulates mobile vendors and how hours of operation would be handled; staff explained transient vending (less than 15 minutes, e.g., ice‑cream trucks) may be permitted in rights of way including residential areas, while longer stationary operations remain limited to commercial zoning districts. Planning and Zoning held a public hearing and unanimously recommended approval; council will address the ordinance at a subsequent meeting.
