Resident alleges code supplement omits prior council action on data-center use; staff to verify redline

At the May 26 meeting Amy Swank raised a procedural concern about the city’s forthcoming code supplement. Swank said she reviewed the April 7, 2025 council minutes and found a motion that allegedly made data centers conditional rather than permitted in the West Innovation District (ID3), but that the supplement does not reflect that change.
"The motion on the floor was very clear...The minutes were very clear," Swank told council and asked staff to audit the supplement and ensure the online code matches council-adopted actions. City staff and the law director responded they would recheck the redline and confirm that the supplemental codification accurately reflects the ordinance language and prior council motions; council requested a specific follow-up at the second reading on June 8.
Staff noted the supplement process is a periodic codification performed by American Legal Publishing and that staff has reviewed 263 pages of the codifier’s draft; staff said they would reconcile council-recorded motions with the codifier’s redline and return with clarifications.
