Commission approves Durango Farms replat after legal guidance on ministerial role

The Hutto Planning and Zoning Commission voted unanimously to approve a replat in the Durango Farms subdivision that creates Lot 2A — a roughly 1.226-acre parcel intended to hold a monument sign and associated landscaping.
Manny Hernandez, speaking for staff, summarized the replat and recommended approval. "After review of the replat, staff recommends approval of it as presented," Hernandez said. Commissioners focused discussion on whether the original plat placed maintenance responsibility with the homeowners association (HOA) or with the developer.
Commissioner Sherrod asked whether the plat explicitly assigned maintenance to the HOA, noting that if it did not, the city or the current property owner could become responsible for repairs. Legal counsel (Deborah) told the commission that deciding ownership or maintenance arrangements is not the commission's purview when a plat meets code. "It is not," she said when asked whether the commission could deny the ministerial plat based on proposed ownership.
Property representatives said the HOA has maintained the site for over two years and that the current owner can deed the parcel to the HOA or otherwise convey it. Wyatt Henderson, who identified himself in the record, said the proposed subdivision is "only asking to have this plan approved" and that subsequent conveyances are the applicant's business.
Given the legal guidance that the commission's action on a compliant plat is ministerial, Commissioner Sherrod moved to approve the replat; the motion carried 4-0.
The approval confirms the replat meets platting standards; ownership and maintenance arrangements will be clarified in the record and through deed instruments outside the commission's ministerial approval. The applicant waived any accelerated approval timeline related to the state's 'shot clock' legislation during the review.
