BZA notes arborist protections and imposes condition that approved carport remain open
Summary
At the May 19 hearing the BZA discussed an arborist report and added a condition to the variance approval that the carport remain open and unchanged to reduce risk of future enclosure; the applicant said an arborist would be on-site during footings.
Planning staff and the applicant referenced an arborist report included with the variance application and discussed protections for nearby oaks during construction. Applicant Laura Bauer told the board the arborist would be present when footings are installed and would advise on placement to avoid root or trunk damage: “He felt like he would be there with us when we put them down…and tell us where and how we could put those down.”
During deliberations Vice Chair Roy Smith expressed concern that a future owner might enclose the carport and effectively create conditioned space only 15 feet from the street. The board responded by adding a condition that the structure remain an open carport in the form originally built; the condition will be recorded with the board’s written decision and enforced by Planning and Zoning staff as part of the approval.
