Hoplin and McLaughlin parties provisionally agree to revised cleanout settlement; attorney to finalize draft

Attorney Sean Fredricks summarized the complaint process and Nathan Trosen reviewed the investigation and hydrologic findings. The parties agreed in principle to a revised settlement: the Hoplin parties will carry out the cleanout at their expense within the culvert-to-culvert, invert-to-invert limits shown on Moore's exhibit; the McLaughlins will modify indemnity language; and Hoplin will not spread spoil on McLaughlins' property. Fredricks will review the updated agreement and provide the draft to the Hoplin parties and serve as intermediary.
The board recorded these terms as the basis for a settlement to be finalized in writing. No formal vote was recorded; the attorneys and parties will complete drafting and circulate the revised agreement for signature.
