The Box Elder County Planning Commission on Jan. 15 voted to forward a recommendation of approval to the County Commission for a zoning map amendment (Z25-016) to change roughly 5.50 acres at approximately 5912 W 2400 N in the Corinne area from RR-20 (Rural Residential) to the Agricultural Heritage Zone (AHZ).
Staff told the commission the parcel is part of an existing Agriculture Protection Area and read relevant approval standards and General Plan language that favors large-lot zoning in the county's agricultural heritage area. County Attorney advice was read into the record indicating the commission may review and recommend a zoning map amendment for the applicant-owned parcel despite its inclusion in an APA because the change would not affect other property owners within the APA.
Commissioner Jared Holmgren moved to forward a recommendation of approval; Commissioner Lonnie Jensen seconded and the motion was carried unanimously. Commissioner Brandon East recused himself from the item and did not participate in the recommendation.
The commission's recommendation includes staff conditions requiring compliance with Article 5 and the applicable sections of the Box Elder County Land Use Management & Development Code and any necessary county, state, and federal permits or licenses.
During the public comment period Dennis Patterson said he was concerned about occupancy on the parcel and the precedent the action could set. "At 5.5 acres it does not qualify for the AHZ," Patterson said, and he asserted that papers and photos show people living on the property. Patterson added, "I am disappointed that my neighbors have to live next to a crappy looking mobile home that probably cost $1,000 parked in the driveway." The commission did not take additional action on Patterson's remarks at the meeting.
Next procedural steps: the Planning Commission's recommendation will be transmitted to the Box Elder County Commission for their review and final action.
