Pueblo County hearing on Evergreen Nursery Farms cites missing records, surveillance gaps and unauthorized containers

Hearing Officer Talbot convened a Liquor Marijuana enforcement hearing addressing alleged violations at Evergreen Nursery Farms, driven by Pueblo County inspector Jessica Lopez’s inspection reports. Lopez testified she conducted inspections on August 18 and September 2, 2025, and found business records that were incomplete and surveillance recordings that did not meet county requirements.
Lopez said she reviewed manifests, invoices, waste and harvest logs and that ‘‘the business records were incomplete.’’ She told the hearing she could not complete a full records review because staff on site lacked access to Metrc, the state track-and-trace system. Inspector Lopez also testified that parts of the facility’s DVR system only preserved video back to September 2 — short of the county’s 30-day requirement — and that several camera images lacked date, time or location stamps.
Licensee Ivan Garcia acknowledged recurring DVR and connectivity problems but said many failures were caused by equipment age or satellite Internet outages. Garcia told the panel he is running a small operation and is ‘‘struggling to make payroll’’ and asked for leniency. Enforcement counsel proposed reducing the previously contemplated penalty and suggested suspending fines pending verification of compliance at a follow-up inspection and a required premises modification for shipping containers.
Hearing Officer Talbot did not issue a ruling at the hearing. He said he would review the testimony and evidence and ‘‘get an order out in 14 days.’’ The officer also instructed the parties to coordinate on a follow-up inspection and on submission of any modification application to address the unauthorized containers.
