Board reviews rules of order, keeps existing language after questions on absences and tie votes

The Chisago County Board of Adjustment & Appeals reviewed its Planning Commission and Board policy at the Jan. 29 meeting and agreed to retain existing wording after staff clarified how terms are used.

Commissioner Gregg Carlson raised three points during the annual review. He asked whether Section 3— which states that "a regular meeting may be cancelled or rescheduled by the Commission/Board or by County Staff (in which there are no planning applications)"—should explicitly reference Variance and Appeal applications. Land Services Coordinator Beth Gervais said the phrase "planning applications" was intended as a general term to include zoning- and permit-related items and reflected older paper-application terminology prior to the county's online permitting system. Following discussion the Board reached consensus to make no change to Section 3.

Carlson also suggested amending Section 11, Rules of Procedure for Meetings, subsection (c), (which states that "all motions shall be carried by a majority vote of the members present and remotely attending") to clarify that a tie vote results in denial; the Board concluded additional language was unnecessary and took no action. Carlson asked whether Section 16, Member Participation, differentiates excused from unexcused absences; Gervais explained it does not differentiate in the text but staff notes absences as "excused" when advance notice is provided and "unexcused" when it is not. Wille moved to re-establish the 2025 policy as the rules of order and operating policies for 2026 without changes; Doug Greene seconded and the motion passed unanimously.

The Board's action preserves the current rules and asked staff to continue noting excused versus unexcused absences according to whether advance notice is given.
