Council authorizes staff to explore foreclosure on three abatement-lien properties

The Town Council voted to direct staff to explore possible foreclosure on abatement liens for three properties: 217 Pima Street, 303 Apache Street, and 103 Tomahawk. Mayor Johann Wallace said the Town has repeatedly spent funds to remediate hazardous conditions at those properties and wants to determine whether foreclosure is practicable and cost-effective.
Town Attorney Thomas Benavidez advised the Council that foreclosure on abatement liens is a complicated process that will itself incur costs and that in the case of 217 Pima the Town has already spent about $16,000 over the years. "The properties may not be worth the cost, but I do not know that for sure," Benavidez said. After discussion, the Council moved to direct staff to investigate the foreclosure process for the three addresses; the motion passed unanimously.
Staff will return with an analysis of costs, likely timelines and estimated recoverable value to help Council decide whether to proceed with formal foreclosure actions.
