Committee directs staff to seek state clarification on Mequon CTH W streetscape liability

The Ozaukee County Public Works Committee voted 3–2 on Jan. 16 to direct staff to seek state clarification about whether the county can enter the proposed streetscape agreement for CTH W in the City of Mequon. The motion passed with Supervisors Grabow, Bichler and Vogel voting aye and Chair M. Wolf and Supervisor J. Strom voting nay.

Public Work Director Edgren provided background on a streetscape plan that has been discussed for several years. Luke Haas, the project designer with Harwood Engineering, said the City of Mequon aims to "create character" in the area and increase lighting. Corporation Counsel Gorden raised concerns over potential "liability" and questioned whether the county has statutory authority to enter the proposed agreement; discussion included self‑insurance, indemnification language and the option of requesting an Attorney General opinion. The minutes show the committee chose to seek clarification from state authorities rather than move immediately to approval.

The motion directed staff to pursue state guidance and report back; the minutes do not identify a specific statute cited during the discussion. The committee took the vote during the highways portion of the agenda after Chair Wolf moved the item forward in the meeting order. The action means staff will return with the state’s guidance or an Attorney General opinion before any final county agreement is executed.
