The Commission considered a side-lot addition for tax map no. 57-09-00-0-091 to be added to 57-09-00-0-033 to remedy a garage encroachment. Surveyor David Lentz presented the plan; abutting owner Gordon Staats raised concerns about private right-of-way access and unauthorized use. The Commission directed plan edits including a revised Statement of Purpose, labeling of the existing driveway, and an amendment to the Owners Certification to identify Darlene Duncan as formerly Darlene Hohn.
Because a garage encroachment makes the structure legally nonconforming, the Commission required a modification request for the minimum front setback and a note acknowledging the garage's nonconforming status if the modification is granted. The plan must show a single front setback line (clarify whether measured from SR 819, the private easement edge, or the common boundary with adjacent Gray property). A Non-Buildable Waiver for Lot 2 must be signed by the owner and submitted for SEO and Township approval, and a revision number/date must be added. The Commission voted unanimously to recommend final approval subject to these conditions.
