Boyle County accepts clean version of public-nuisance ordinance after penalty review

The Boyle County Fiscal Court approved the second reading of a public-nuisance ordinance on July 28 after staff circulated a clean version that excluded proposed class B misdemeanor penalty language. County lawyers and staff had reviewed the potential penalty changes and concluded that the county lacked clear statutory authority to impose a class B misdemeanor penalty, which led to removal of that language.
Director Angie Muncie presented the ordinance and described the edits. Committee members saw the revised "clean" draft and discussed enforcement provisions and penalty language; the judge confirmed the court had the clean version before voting. "We have the clean version," a magistrate noted during the exchange. The court carried the second-reading motion by voice vote.
