County legal and audit staff (S33, S34) told the court the contract meets minimal legal standards but that the scope-of-work language is broad and could make it difficult to audit performance; they recommended either an hourly rate or a well-defined scope with measurable deliverables to avoid misclassification or potential constitutional/gift issues. Precinct and county leadership said the position was budgeted under personnel-services allocations and that the DA’s office had reviewed a prior exemplar contract.
Commissioner Flores voted against the item on principle, but a majority of the court approved the contract and recorded the objection. The court’s action leaves staff to proceed under the existing contract terms, and audit/legal staff recommended future procurement practices require clearer scope and monitoring.
