Shelby County grants Alabama Power easement over landfill for $221,000, with construction limits

The Shelby County Commission approved Resolution 2026-07-13-06 on July 13 to convey a right-of-way easement over portions of the county landfill to Alabama Power Company in exchange for $221,000.
Resolution language, as recorded in the meeting packet and easement instrument, describes a strip of right-of-way 125 feet in width centered on a surveyed line across specified sections and parcels, limits excavation within 20 feet of structures or guy wires, expressly prohibits underground boring, and requires that any guy wires be highly visible. The easement instrument also places responsibility on the Grantee to comply with federal, state and local environmental regulations and to indemnify the Grantor for violations. The resolution cites the county’s authority under Ala. Code § 11-14-2 and delegates authority to the County Manager to execute an easement consistent with the resolution.
The motion was made by Commissioner Lindsey Allison, seconded by Commissioner Robbie Hayes, and passed unanimously.
