Court approves discretionary procurement exemptions; staff cites pending state change to bid threshold

County procurement staff asked the court to approve a list of discretionary procurement exemptions authorized under the Texas Local Government Code (LGC 262.0224), which permit exemptions for purchases such as emergency work, professional services and auction-sourced personal property when certain conditions are met.
Staff explained the exemptions are required for county purchases in certain scenarios, including buying items at auction and for calamity response, and recommended the court authorize the list in the packet. "There's, 11 items under there," staff said, explaining the need to have the discretionary exemption and a purchase order in place. Staff also told the court there is legislation that, if enacted, would increase the county's informal-bid threshold from $50,000 to $100,000 and that change would take effect in October if signed by the governor.
Commissioners discussed how the exemption interacts with county policy requiring multiple quotes for purchases under $50,000 and then approved the exemptions by unanimous vote.
