Legislature advances changes to Sewer Use Law to enforce outside-user allocations

Legislator Barry J. Cheney moved to amend and restate Local Law No. 7 of 2006 to add definitions for “Restricted Contract User” and “Unauthorized Out-of-District User,” and to add enforcement provisions in Sections 3.10 and 3.11. Mr. Mahoney told the committee the changes would let the county enforce contract allocations and treat unauthorized discharges by outside users as violations of the Orange County Sewer Use Law.
"The Clean Water Act federal legislation requires all districts and operators of certain plants to be able to enforce contracts with those outside of its geographic borders," Mr. Mahoney said, explaining the amendments are intended to ensure compliance and allow the administrative head to act against entities exceeding allocations. Legislators pressed for clarity on allocations tied to a pending 3-million-gallon expansion and were told allocation specifics are still being negotiated under intermunicipal agreements.
