At the City of Crooks council meeting a resident who identified herself as Patty told the council she and her husband are petitioners in a lawsuit challenging a conditional‑use permit granted for Smithfield in Sioux Falls. She said neighbors did not receive required notices, alleged the applicant failed to prepare a comprehensive plan addressing litter, odor and solid waste, and said the project’s wastewater treatment approach appears to have been scaled back from a full treatment plant to only pre‑treatment.
“We are one of the petitioners in the lawsuit against the city of Sioux Falls, in regards to the Smithfield conditional use permit,” Patty said during the public‑comment period, urging the council to stay informed. She asked the city to inform petitioners when the city’s response to the petitioners’ counsel is filed; she said the city has until May 5 to respond to their credentials. Patty also raised concerns about truck traffic, school‑zone safety and the absence of documentation showing Army Corps of Engineers permitting for wetlands or related work.
Council members did not take formal action on the points presented during public comment. Chair said the city would receive the legal filing and that the council would be notified when the city’s counsel receives the petitioners’ materials. The council did not endorse or reject the claims at the meeting; the matter remains pending in court.
