Commission recommends Heritage Gardens FDP amendment to revive 147 single‑family lots, with private gardens and trail relocation

Planning staff presented amendments to the Heritage Gardens final development plan that would carry forward prior PNZ‑approved changes (2022) and enable single‑family development in the southern phase. Rick Murphy, entitlements manager for Lennar Homes of Wisconsin LLC, said Lennar plans a mix of ranch and two‑story homes with multiple elevations and a staffed welcome center to support sales.
Staff explained the amendments would: implement previously approved but unrecorded changes from 2022; convert a duplex area to single‑family homes; allow some flexibility in residential design standards; relocate the bike/ped path to follow the waterway; and add language allowing the village to assume ownership or maintenance of outlots with the owner's agreement. Staff also said Lennar will contribute park fees to enable development of Iver Munson Park adjacent to the site.
On Intermeso Gardens, staff said the feature is intended as privately owned and maintained (the owner, Elaine Erickson, has created a foundation to fund maintenance). "They're scheduled to be privately owned, privately maintained, and available for events," staff said. Commissioners clarified that the gardens are not being offered for park credit and that public access would depend on the owner/foundation.
Commissioners asked about phasing, stormwater basins and trail continuity. Staff described sanitary sewer and construction sequencing constraints and said stormwater basins have been updated to current standards; a recent wetland delineation was updated last year. After discussion, the commission recommended approval of the FDP amendment and related technical conditions to the village board. The motion passed unanimously 7–0.
Next steps: the village board will consider the final development plan amendment and related recording/plat actions; engineering, stormwater and any outstanding easement issues must be resolved before site work and recording.
