Commission approves setback variance for Kenneth Cox at 337 Mercury Avenue

Ian Collier, planning staff, told the commission VAR25-005 requested a front-yard setback reduction from 50 to 25 feet and a side-yard reduction from 20 to 12 feet to accommodate an existing 12-by-30 steel carport on Lot 11, Block A of Wild Horse Estates (APN 085001-011) at 337 Mercury Avenue. Collier said staff recommended approval with conditions, including compliance with Elko County Code Title 4, Chapter 9, Section 5, and that deed conveyances include verbiage adopting the variance conditions if the property is later sold.
Corey Rice said the applicant had been cooperative, that the carport is on a concrete foundation and that a Connex container previously on the property had been moved out of setback areas. Applicant Kenneth Cox told the commission he had installed septic and well systems and acknowledged placing the carport without a permit: "I made the mistake but ... I do appreciate the fact that we can move forward with this," Cox said. A commissioner moved to approve VAR25-005 with staff recommendations; the motion was seconded and approved on a voice vote.
