Corey, planning staff, presented the application and told the commission staff received no objections from local agencies and recommended approval with conditions per Elko County Code, including deed language binding future owners to the findings and requirements. The staff report described the kennel as an existing structure on a concrete slab and noted the variance is subject to Elko County Code provisions.
The owner, who identified himself on the record as Jeremiah Davis (the staff reading of the application used the form name "Jeremiah Davison"), said he built the kennel for his own bird dogs, received a red tag, and came to the office to correct the matter. He told commissioners he had spoken with neighbors and had not received complaints. One commissioner announced an abstention from the vote for work reasons; despite that the motion to approve VAR25-004 with staff recommendations carried on voice vote.
After the vote staff and commissioners advised the owner he may need to upgrade his septic system as part of compliance and offered to help him follow up with the Nevada Department of Environmental Protection and related agencies.
