Herring said the Muscogee Creek Nation had contributed funds that were used for water and wastewater improvements ‘‘for the benefit of the public,’’ so providing a gift could be argued to be a public-purpose recognition but left room for doubt. Because legal questions remained, the board took no formal action on the purchase; a member of the audience said he would personally donate the money to buy the peaches.
