Developer Markovich told the board he constructed a retention pond to serve nearby lots and that, in hindsight, he would have arranged for an HOA or POA agreement to ensure long-term maintenance. "Do an if or, I would think. Just say we would prefer the board would prefer you to join a POA and agree to this in perpetuity. Otherwise, the town's gonna be forced to do a special exception and send it to the tax bill," Markovich said as an example of wording he could include. He offered to solicit signatures from lot owners and suggested a modest fee (he floated $100 a year) to cover mowing and maintenance.
Board members discussed the legal route of a special assessment for drainage in a defined area and asked staff and the town attorney to draft a letter the developer could distribute to homeowners.
