LCB to present CR102 implementing HB1602 allowing contract kitchens and mobile food trucks for breweries

Jeff previewed a CR102 rulemaking package that implements engrossed House Bill 1602, which allows breweries and microbreweries to contract with others — including mobile food trucks — or to operate a mobile food truck themselves to satisfy food-service requirements for beer-and-wine or spirits-restaurant licenses. "This law allows for the breweries or micro breweries to subcontract with 1 or more individuals or entities, including mobile food trucks to satisfy the food service requirements necessary to obtain and maintain a beer and wine restaurant or spirits, beer and wine restaurant license," Jeff said.

Jeff said the agency filed a CR101 on 09/03/2025 (WSR2519-2) and held an informal comment period and a virtual stakeholder meeting in October 2025; he will present a more detailed analysis to the board at the upcoming meeting and answer questions about implementation and draft rule language. The caucus did not vote on CR102; staff will request board approval at the formal board meeting the following day.

Why it matters: if adopted, the rule will let smaller breweries use contracted food providers or mobile operations to meet food-service obligations, potentially lowering barriers to operating on-premises alcohol service. The caucus will review the full rule package and stakeholder input at the board meeting.
