The Spring Valley CID No. 1 board approved a motion to vacate a right-of-way easement encumbering Lot 25, Block 1 of the subdivision, contingent on the city approving the vacation and reimbursing the CID for any funds owed.
Bond counsel explained the easement was originally dedicated to provide access to Lot 26 but is no longer needed due to other rights-of-way that were later dedicated. "This was, originally there was a right of way easement that went across Lot 25 in order to provide access to Lot 26...based on the way the other rights of way ended up being dedicated, this is no longer needed," counsel said. Counsel recommended approving the vacation contingent on city approval and reimbursement for any owed funds; the board moved, seconded and approved the contingent action.
The motion specifies the contingent nature of the approval; the board directed that the CID's approval is subject to the city’s action and to reimbursement where applicable.
