Corey Rydes (speaker 10), the county surveyor and senior planner, summarized an application from the Webbers to vacate a 50‑foot public right‑of‑way the applicant argued was unused and difficult to improve. "The right of way is currently not improved at all and would be relatively difficult to improve," Rydes said, and noted that utility companies and the city of Elko raised no blocking objections to the vacation.
Adjacent residents raised concerns about drainage and maintenance. One commenter introduced himself as "Bruce Winston" and asked, "I'm just curious why do we need to vacate it?" He said he was worried that vacationing the strip would remove legal access to maintain fire breaks and clear brush behind his fence. County engineers and the applicant's surveyor explained the primary drainage channel did not cross the portion being vacated and offered that the Webbers would maintain the strip. After discussion commissioners amended the motion to require a 10‑foot drainage and utility easement on the north side of the fence, and the board approved Resolution 2026‑02 as amended.
Staff and the applicant agreed to clarify clerical errors in the resolution and to add a condition granting the drainage and utility easement. The board recorded the motion carried and directed staff to incorporate the easement language into the final recorded documents.
