Clark‑Shawnee School Board raises staffing and legal concerns during subdivision hearing

Brian Kuhn, speaking on behalf of the Clark‑Shawnee School Board, told the CEDA Regional Planning Commission during the public hearing on Arrival at Melody Parks Phase 1 that the board had concerns about the adequacy of public services and legal obligations the commission must consider.

Kuhn read from a prepared statement and said the commission could not consider “the CRA and other funding mechanisms,” invoked duties described in ORC 713.23, and raised concerns that the Springfield Fire Division and Springfield Police Division were at minimum staffing levels required by the city charter. He warned that insufficient public services could force the school district to make cuts. Kuhn also asserted that a judge had ruled a previous plat approval (phase 1 and 1‑B) denied and questioned whether the county could legally approve the current plat in light of that ruling.

County staff member Ethan Harris responded to the court‑ruling claim, saying, “that is not the interpretation of the—what the judge has said in the case.” Developer representative Connor Westerheide also disputed Kuhn’s reading of the judgment, saying the ruling concerned meeting minutes and did not affect the previously constructed homes, and he said the phase before the commission was distinct from the one Kuhn referenced.

The commission heard these concerns during public comment but proceeded to vote to approve the plat with staff conditions. The transcript records this exchange and the staff dispute over the legal interpretation; the claim about the judge’s ruling was explicitly contested in the hearing.
