Commission approves Hamilton Road rezoning with restriction on Dunn Street access

At a public hearing the board considered a rezoning application that would transfer roughly 2.24 acres from residential to commercial and 3 acres from commercial to residential on Hamilton Road. Planner Ruth and staff explained the request and recommended approval with a restriction that would prohibit vehicular access from Dunn Street to any commercial uses created by the rezoning.
Neighbor Ty Foote, who lives on Dallas Mill Road adjacent to the property, asked what would be built and raised concerns about buffering, drainage and privacy fencing. Applicant Shelly Anthony III said the current plan is to build about 16 houses served by wells and septic. "This property is gonna be used for houses... we're gonna build 16 houses," Anthony said. Several supporters, including property owner Peter Brochu, described prior rezoning history and how the parcel layout would provide buffers.
The planning commission and staff recommended a conditional approval limiting access from Dunn Street; Commissioner moved to approve the rezoning with that restriction explicitly included in the motion and the board carried the measure.
