New owner told to resolve unpermitted dock at Buckeye Avenue property; magistrate says owner is responsible

Paul Davis, a Charlotte County certified code compliance officer, testified that the property at 168 Buckeye Avenue had a dock installed without the required permits and that the violation persisted through the final inspection. The new owner, Chelsea Bast, said she purchased the property on March 20 and relied on the seller's disclosure that no unpermitted work had been done. She said obtaining engineered recertification and permit fees could cost between $1,500 and $2,500 and that she was seeking legal counsel.
The magistrate acknowledged Bast's concerns but noted that as owner she is responsible for correcting permitted work prior to noncompliance penalties. "Unfortunately, as you as the owner, you're responsible," the magistrate said, then issued a 30‑day compliance order and a $50/day fine provision for ongoing noncompliance, and encouraged Ms. Bast to coordinate with county staff while pursuing any legal remedies against the seller.
