Charlotte County planning staff and the applicant's attorney told the Planning and Zoning Board that the proposed Planned Development rezoning for 5905 Duncan Road is intentionally narrower than a straight Commercial General rezoning and includes conditions to limit development intensity and protect adjacent residential areas. The board voted to forward PD-25-14 to the Board of County Commissioners with recommended conditions a–m.
Planner Jay Shell described multiple PD limits: a maximum floor-area ratio of 0.375 (compared with 1.0 under a straight CG designation), combined square-footage limits for permitted commercial uses on the front lots, and a restriction that Lot 4 be limited to either a hotel with a maximum of 125 rooms or an indoor storage facility with up to 140,000 square feet in a single building. Shell also said the PD requires enhanced architectural treatments on primary facades, a minimum type-A buffer with canopy and accent trees and perimeter hedgerows along US 17, and that the applicant submitted a native-habitat management plan to protect approximately 1.91 acres of on-site wetland and associated upland.
Applicant counsel Derek Rooney said the applicant has no end user yet and that the PD was drafted to be realistic for market demand while protecting nearby residential properties. "We don't have an end user in place," Rooney said, and he noted staff and applicant removed high-impact uses such as gas stations from the proposal. After board questions clarified that any change to Lot 4's allowed uses would require returning to the board for a PD modification, a motion to forward PD-25-14 with conditions passed unanimously.
