Owners told to contact Natural Resources after clearing reported in scrub‑jay habitat at Ashwood Road property

Gloria Walberg, a Charlotte County certified code compliance officer and environmental/landscape inspector, told the magistrate she observed clearing within scrub‑jay habitat and remaining piles of tree debris at 5399 Ashwood Road and offered photographs as County composite Exhibit 1. "I conducted an inspection and observed the following violations of clearing within scrub J habitat without a permit and piles of tree debris remaining creating a junk like condition," Walberg said.

Respondents Deborah and Mark Devine disputed aspects of the photographic record, saying some images were older and that they had been on site. Walberg advised them to contact Natural Resources and Jamie Scudera to obtain a settlement agreement and to pay the applicable scrub‑jay fees. The magistrate admitted the photos and issued an order requiring compliance and reinspection but did not impose a fine at that time; the magistrate warned that future reinspections showing continued noncompliance could lead to fines.
