John Brown, a Charlotte County certified code compliance officer, told the magistrate he re‑inspected 8339 Roosevelt Street on Jan. 12, 2026 and observed junk‑like debris on a trailer, items outside the fence and people occupying travel trailers in the backyard — conditions the officer said were not permitted. "On the day of inspection, there was still junk like debris stored on a trailer... he has people occupying the mobile homes or in their travel trailers in the backyard," Brown said.
Owner Daniel Ball said most of the time the property is maintained and that the day of inspection was an outlier; he also said he had been helping people with nowhere else to go. "I don't collect rent from them. I just helping people out," Ball said in his testimony. The magistrate credited the officer's account and issued a second‑level (90‑day) fine of $4,520, finding the county had proven the violation. The magistrate reiterated that screening items from view does not legalize a prohibited use: "If the use is prohibited, you can't screen it to make it allowed."
