Council recalls vote and schedules new hearing on odor nuisance ordinance

The St. Bernard Parish Council recalled and tabled its recent action on an ordinance intended to add an odor-nuisance article to Chapter 11 of the parish code.
On March 17 Councilmember Patrice Cusimano moved to amend Summary No. 4336, "AN ORDINANCE TO AMEND CHAPTER 11, HEALTH AND SANITATION; TO CREATE AND ADD ARTICLE X, FACTORIES, PLANTS, ETC., CREATING NOXIOUS ODORS ODOR NUISANCES OF THE ST. BERNARD PARISH CODE OF ORDINANCES," and the council initially adopted the amendment by unanimous vote. The minutes record the chair casting his vote as YEA.
Later in the same meeting, on motion of Gillis McCloskey the council voted to recall item #16, saying a vote should not have been taken after the amendment because additional public input was needed. The recall passed unanimously, and the council then moved to table Summary No. 4336 until the April 7, 2026 council meeting. The minutes specify an additional public hearing will be held April 7 at 7:00 p.m. because the amendment represented significant changes.
The action means the ordinance, as amended on March 17, will not take effect and will be reconsidered after the April 7 hearing. The clerk’s office holds the full ordinance text and related materials on file for public inspection.
What happens next: the council will hold the additional public hearing at the April 7 council meeting and may vote thereafter; until that process is completed, the parish code is unchanged.
