County approves 20-year franchise for East River Electric Cooperative

At an 8:30 a.m. public hearing May 6, the Clark County Board of Commissioners voted to approve Resolution 12-25, granting East River Electric Cooperative the right to construct and maintain transmission and distribution lines across public highways for a period of 20 years.
Jerae Wire, representing East River Electric Cooperative, told the board the agreement “will be effective for twenty years from the date of signature.” Vice Chairman Sara Gjerde opened the hearing, and after board questions the resolution passed with Commissioners Chris Sass, Francis Hass, Sara Gjerde and Terry Schlagel voting aye.
The signed resolution cites Chapter 31-26 of the South Dakota Codified Laws and states the franchise covers existing transmission lines and planned extensions for rural electrification countywide. No one appeared in opposition at the hearing, per the board record.
The resolution was recorded and attested by County Auditor Christine Tarbox; the board did not note additional conditions beyond the statutory terms listed in the resolution.
