Giddings council amends mobile food vendor rules to align with state law

The Giddings City Council adopted Ordinance No. 926 on July 13, 2026, amending Article 4.10 of the municipal code to bring local regulation of mobile food vendors into conformity with recent state legislation. Interim City Manager Heather Garner explained that the existing code allowed mobile food unit permits only in commercially zoned locations, but new state law that took effect July 1 requires that licensing and permitting be handled at the state level.
"This ordinance will eliminate inconsistencies with state law," Heather Garner said. She also said council could consider zoning-based location restrictions through the zoning code later if it wishes. Council Member Kevin Rinn moved to adopt the ordinance; Council Member John Dowell seconded, and the ordinance passed with a unanimous vote.
The change removes conflicting local permit language and leaves municipal zoning authority available for any location-based restrictions the council might pursue separately.
