Morton County OKs emergency permit for pediatric behavioral evaluations at health department

County Counselor David A. Thompson reviewed and recommended approval of an Emergency Temporary Facility Use Permit and License for Integrated Behavioral Technologies, Inc. (IBT) to use space at the Morton County Health Department (625 Colorado Street, Elkhart) on June 16, 2026 for pre-booked pediatric behavioral-health evaluations. Counselor Thompson said the vendor's initially proposed memorandum of understanding contained statutory and liability defects; the emergency license imposes a HIPAA data air gap, requires prominent "Independent Contractor" signage inside the facility, and secures vendor indemnification under Kansas House Bill 2116.
Health Department Administrator Kendra Walsh confirmed that IBT's active certificate of insurance had been received and that patient disclosure and facility check-in forms were prepared for execution. Commissioner J.W. Finn moved to approve the emergency permit under K.S.A. 19-212 and authorized Chairman Jim Tucker to execute the agreement on behalf of the county; Vice-Chairman Ed Anderson seconded and the motion carried unanimously.
