Shelby County trustee raises concerns about monitoring, delinquent pilot payments and enforcement options

Regina Newman, Shelby County trustee, told the committee her office'9s pilot report is focused on fiscal measures and billing rather than on whether recipients have met the non-financial terms of their pilot agreements.

"We are abating taxes with pilots in the amount of about $40,000,000 a year," Newman said, and she explained the trustee'9s role in tracking pilot bills and pursuing delinquent pilot payments. Newman said delinquencies were reduced from about $2,500,000 when she took office to a much smaller amount as of Feb. 28, and that the trustee'9s office notifies relevant boards and works with legal counsel to terminate contracts or pursue court remedies when recipients do not make required pilot payments.

Newman also described how pilot contracts can freeze an appraisal for the contract term so growth in assessed value is not captured while a property is under a pilot, and she warned that retroactive extensions by some boards can complicate collection and program administration.

Committee members discussed the trustee'9s limited capacity to monitor contractual promises such as hiring commitments, and several members said the county needs better shared data and monitoring standards to determine whether pilot recipients met the terms that justified abatement.

"There's no point in having a pilot that's not even paying their pilot contract," Newman said, urging the committee to consider enforcement mechanisms and whether boards should use standard language and monitoring benchmarks in pilot agreements.
