Senate passes bill limiting landlords’ ability to prohibit tenants’ lawful firearm possession

Senator Harshbarger moved Senate Bill 350 on third and final consideration, saying the bill "prohibits landlords from prohibiting a tenant or a tenant's guest from lawfully possessing, carrying, transporting, or storing a firearm or ammunition" in the tenant’s home, in a vehicle parked in tenant-provided spaces and in other locations controlled by a landlord.
During floor discussion senators asked whether the bill applies to all landlords, including single-home landlords and hotels that lease space to residents alongside restaurants or event spaces. Senator Yarbrough raised concerns about property rights and the ability of property owners to control common areas and the safety risks of removing landlord authority to restrict firearms on their property. The sponsor clarified the bill is placed in Title 66 and therefore covers both commercial and residential contexts.
After debate the Senate voted on the bill and the clerk recorded that Senate Bill 350 had received a constitutional majority and was declared passed; the transcript records the final tally as Ayes 27, Nays 5. The motion to reconsider was tabled.
