Commission moves to vacate interior rights-of-way in El Mirador subdivision after homeowner association asks to post signs

The Taos County commission approved a resolution to declare vacation and abandonment of certain county rights-of-way within the El Mirador subdivision, a correction staff said was needed to clear a 1996 documentation inconsistency.
Patrick (staff) explained that when the subdivision was approved the county accepted rights-of-way dedication but never accepted maintenance responsibility; the association has been maintaining the interior roads for years. "This resolution is meant to correct a mistake that was done way back in 1996 when the El Mirador Subdivision was approved," Patrick said, noting the proposed action would clarify ownership and maintenance responsibilities.
Ron Banther, vice president of the El Mirador Property Owners Association, addressed the commission during the public hearing. "We maintain it, and the road's in actually very good condition right now," Banther said. He told the board the association wants to post speed-limit and no-trespassing signs and asked that the county formally remove potential liability by vacating the county's record of the interior easements.
Commissioners acknowledged longstanding confusion in records and asked staff to continue reviewing plats and clerk-recording status for similar old subdivisions. The board opened public comment for the item, heard the association representative, closed the hearing and approved Resolution 25-19.
