Council allows movable carport in alley with permit, warns about right-of-way access

The Montrose City Council on June 10 approved a motion allowing a movable carport to be installed in a city alley right-of-way, pending the completion of a building permit and with the caveat that the structure may need relocation if it obstructs access to other properties.
Citizen Vosburg requested permission to place a movable carport secured with 2-foot ground anchors and to add crushed concrete to the alleyway near his property. Councilor Hanisch cautioned the group to consider right-of-way access for adjacent properties to the west and said that if a complaint is filed the carport would have to be moved within private property lines. The motion (Action 25-080) to permit the carport contingent on a permit and to allow crushed concrete in the alley passed with “all favored, no opposition.”
Councilor Vogel said the city must protect neighbor access while permitting reasonable temporary structures, and Mayor Painter reminded the meeting that the city’s authority over structures on private property is limited. The council did not record any amendments to the motion; enforcement would follow standard complaint and permit procedures if neighbors raise access concerns.
