City legal counsel summarized intergovernmental steps required to deliver the 4100 South extension and said that West Valley City has already approved final plans. Bracken said a municipal boundary adjustment will be pursued so the road and impacted property fall within Magna's jurisdiction.
Bracken told the council, "We just got word last week from Rio Tinto that they are willing to convey that the final remaining parcel that we need there," and that Rio Tinto will provide documentation authorizing construction on that portion of the property while conveyance proceeds. Bracken noted state law requires at least a two-month process for the boundary adjustment and that West Valley City staff are preparing the necessary paperwork.
If the Rio Tinto conveyance cannot be finalized, Bracken said an alternative routing at Hallville Road could remove the need for the Rio Tinto parcel. The council was informed these land and boundary steps must be completed alongside the funding and permitting process before full transfer of jurisdiction occurs.
