Board approves parental opt-out resolution after debate over process

The Hardyston Township Board of Education voted to approve Resolution No. 2025-01 establishing a parental-notification and opt-out process for lessons or curriculum materials that include LGBTQ-themed content or discussions that parents may find objectionable. The resolution directs the district to notify parents at least one week in advance of such lessons, to provide details including educational purpose and schedule, and allows parents to opt students out by submitting a standardized written request at least two school days before the lesson.

"Parents and guardians may opt their children out of such lessons or materials by submitting a written request via a standardized form on the district's website at least two school days prior," the motion text said. Supporters argued the item implements guidance from a recent high-court decision extending opt-out rights beyond health education; opponents questioned why the resolution appeared on the full-board agenda on short notice instead of being vetted in committee.

The superintendent told trustees the district currently does not have any LGBTQ-specific curriculum in place and said opt-outs historically applied primarily to health instruction; the board debated whether the measure was an administrative notification or a policy-level item. Several trustees asked the curriculum committee to follow up on implementation details, including opt-out form language, notification templates, and alternative assignments for students who opt out.

The motion passed on a roll-call vote. The clerk recorded nine yes votes, zero no votes, and one absence. The board set the resolution as an interim compliance measure until the superintendent develops final guidelines and templates. Trustees said the item was intended as a transparency measure to give parents advance notice if curriculum content changes in the future.
