The Colfax City Council voted unanimously Sept. 15 to adopt Ordinance 25-05, vacating a portion of South Mill Street between Cooper Street and the Flood Control to clear a title issue for a private property.
At a public hearing opened by Mayor Jim Retzer at 7:05 p.m., Building and Community Development official Shawn McSweeney read the ordinance’s legal description and told the council the proposed street vacation "will not hinder access for the city." City Administrator Matt Hammer agreed, noting "the city does not currently maintain this portion of the street." Property owner Leslie Cloaninger said the parcel "had been in the family since 1950" and requested the vacation to ensure a clear title in anticipation of a future sale after confirming the garage did not encroach into the right-of-way.
Retzer solicited public comment and received none. Councilmember Golden moved to approve the ordinance; Schaefer seconded. The motion passed on a roll-call vote with all present voting yes. Retzer closed the hearing at 7:11 p.m.
The council record shows the city will retain necessary access rights and staff indicated no immediate change in the city’s maintenance responsibilities for the segment. No follow-up direction or timeline for record changes was recorded at the meeting.
